UAE Caps E-Invoicing Penalties at AED 50,000 and Removes Daily System-Failure Fine

The UAE Ministry of Finance has revised administrative penalties under its e-invoicing framework. The new rules introduce a maximum AED 50,000 penalty for specified implementation violations, remove the daily fine for failure to report system failures and prevent duplicate penalties for the same violation.

DUBAI, UAE – 30 October 2026: The UAE Ministry of Finance has introduced changes to the administrative penalty framework governing electronic invoicing, providing businesses with greater clarity and reducing certain compliance-related financial burdens ahead of the mandatory e-invoicing rollout.

The amendments were announced on 30 October 2026 through a new Cabinet Decision No. 173 of 2026, which replaces the previous Cabinet Decision No. 106 of 2025.

AED 50,000 Maximum Penalty for Implementation Violations

Under the revised framework, businesses that fail to implement the electronic invoicing system or meet the applicable implementation requirements may face an initial penalty of AED 5,000, followed by AED 5,000 for each subsequent month or part of a month during which the violation continues.

However, the total penalty for these specified violations is now limited to AED 50,000 over any period of 12 consecutive months. This introduces a defined ceiling on the accumulation of implementation-related fines.

Daily System-Failure Reporting Penalty Removed

Another significant amendment removes the administrative penalty previously imposed on invoice issuers and recipients for failing to notify the Federal Tax Authority (FTA) of an electronic invoicing system failure.

Previously, the penalty was AED 1,000 for each day or part of a day of delay. Its removal follows earlier amendments to the electronic invoicing requirements concerning system-failure notifications.

Protection Against Duplicate Penalties

The revised decision also clarifies that a business acting as both an invoice issuer and recipient will not receive multiple administrative penalties for the same violation merely because it performs both roles.

Only one penalty will apply to the same person for the same violation under the revised framework. Separate violations may still attract separate penalties.

E-Invoicing Implementation Deadlines Remain Important

The changes concern the administrative penalty framework and do not remove businesses' obligations to prepare for mandatory electronic invoicing.

Under the announced implementation schedule, businesses with annual revenue of AED 50 million or more were required to appoint an Accredited Service Provider by 30 October 2026, with mandatory implementation scheduled for 1 January 2027.

Businesses with annual revenue below AED 50 million have until 31 March 2027 to appoint an Accredited Service Provider, with implementation scheduled to begin on 1 July 2027.

What Businesses Should Do

Businesses should continue preparing their accounting and invoicing systems, appoint an accredited service provider where required and ensure that their invoicing processes meet the applicable technical and regulatory requirements.

The revised penalty structure provides greater certainty regarding specified violations, but it does not exempt businesses from complying with the UAE's electronic invoicing obligations.

The amendments represent another step in the UAE's transition towards a digital tax administration system while seeking to maintain a proportionate and business-friendly compliance framework.
